Fake Apple Iphone 5s on Ebay being sold as genuine

Dear Ebay,


This is in regard to the Iphone 5s I purchased from your website on 2nd June 2016. It has only been 2 months and the phone has already become completely unusable! And to top that, IT’s FAKE which I found out from the apple store after visiting today. The serial no. of the phone states it is a grey iPhone 5s 16 GB whereas my Iphone is a gold 64 GB.


At first, the 3G started acting up and it hadn’t even been a month. Whenever I was using 3G, the network kept dropping every 3 seconds. I initially thought it was an issue with the sim card so I asked my service provider for a card replacement but even after that I was facing the same issue. Post which I decided to contact the seller but it was of no use as he said the issue was with hardware and he only gave a 1 month guarantee for hardware. I then asked him if the phone was refurbished to which he said "it wasn’t", which was a lie!   I asked him if he could do anything at all and he said, you only paid so much for a gold 5S 64 GB Phone. We can’t do anything. What kind of response is that? Just because I paid lesser than the market price doesn’t mean I deserve a spoiled phone! If I knew it was going to be a fake, spoiled phone I wouldn’t have purchased it at all!


I even spoke to one of your team members and they said the same thing so I decided to let it go and use it as it is for sometime, but the phone kept getting worse.


When I started using the phone with only 2G service, it was working fine initially but even that started acting up and the network kept dropping every few seconds, so I decided to stop using the mobile data completely and use the phone for calls and messages only.


Now, the phone doesn’t work at all(even for calls and messages) and only shows’no service’. When I put the sim card on other phones it seems to work absolutely fine!


Apart from the network issue, the phone also keeps getting hung which I have to fix by pressing the lock button and then unlocking it, over and over again.


I do NOT think that Rs. 22, 500/- is a small amount for a FAKE, SPOILED PHONE! In just 2 months I faced so many issues and I will NOT let this go.


How do you allow such sellers to sell items on your website? All my friends and family warned me not to buy anything from your website but I went ahead and bought anyway, and I had to experience this! They were absolutely right!


I would request you to assist me on this to get the full refund or else I will have to go to consumer court.
