CRUSADE THROUGH JUDICIARY FOR SOCIAL JUSTICE.
1. Tinaikar Report : The Maharashtra Govt. had appointed a committee under the chairmanship of Shri S.S.Tinaikar, the former Brihanmumbai Municipal Corporation(BMC) Commissioner on the corruption in BMC. Though the report was submitted to the government in 2001, the government didnt publish the same for public. Manch filed the PIL(Public Interest Litigation) in the Bombay High Court against the government for publishing the same which is pending.
2. Mismanagement and corruption in Charity Commissioners Office: The Petition filed relying merely on press repoprts, was dismissed.
3. Corruption in BMCs road and building construction & maintenance dept. as well as accounts dept. Petition filed but dismissed.
6. Demolition of illegal religious structures: Thousands of illegal temples, mosques, gurudwaras, churches & squares have mushroomed on public and private properties especially on roads and footpaths causing noise, traffic problems and communal disharmony at times. The Petition filed and the court was pleased to ask BMC to demolish such structures and file the report before the court. Demolition has commenced in full swing. Over one thousand illegal places of worship demolished by BMC.
7. MLA Gymkhana on a Cuffe Parade Playground: The Petition filed against construction of exclusive Gymkhana mostly from State fund for MLAs, MPs and IAS officers. Government amended The Maharashtra Legislature Members Salaries and Allowances Act(Bom.XLIX of 1956 to preempt the petition. Manch challenged the Act. Petition pending for hearing.
8. Dereservation of plot reserved for Jijamata Zoo expansion: A 15 acre plot in the heart of the Mumbai City, leased by govt. to Mafatlal Industries for setting up and running a textile mill, since closed down, reserved for zoo extension was proposed for derservation by government in favour of Mafatlals for commercial development. Manch issued notice in May 2002 to government that if government dereserved the same, it would challenge the action in the Bombay High Court. Government has not proceded further in the matter since then but suddenly decided to deserve half of 15 acres and hand over to Mafatlals. The Manch filed the PIL against the Government and Mafatlals on 3rd March 2004.
10. J.J.Hospital Doctors Sheltering Criminal: The doctors in a nexus with criminals admit them under fake names and facilitate them to flee or obtain bails under the blessing of the ministers and top officials. Manch filed the petition to punish such doctors named in two inquiry reports. Earlier one committee could not work at all. The last and 4th enquiry report accepted and endorsed by the CM was promised by the govt. for action and will be submitted to the Court, with a copy to the Manch before 22-3-2004. Courts final order will follow soon.
11. Religious rituals causing water pollution:
12. Unpaid and unlicensed advertisements dotting Mumbai streets: Banners, signboards, cards and
hoardings put up by the organizers of religious and political congregations, congratulatory displays by politicians sycophants on leaders birthdays and elections are mostly unpaid and unlicensed which cause crores of rupees revenue loss to BMC. Manch filed a writ and the court ordered BMC and the Government to remove them forthwith and award the penalty and punishment under the law to the offenders. The Court finally ordered the BMC and the Government on 25th Feb. 2004 to enforce the law strictly against the illegal display of such advertisements.
14. Petition against a Canadian faith healer:
15. Janhit Manch sent notices to the Prime Minister and the Foreign Minister objecting against over Rs.200 crores subsidy annually given to Haj pilgrims and warned that if the same was not stopped, Manch would go to court. The details of financial support given to the followers of other religions was also sought and further that the state fund could not be misused for religious purposes in a secular country-like ours, the constitution of which forbid such help to religious outfits.
16. Come elections and the newspapers and TV channels have bonanza of state advertisements claiming the big achievements, right or wrong, spending hundreds of crore of rupees state fund. The Manch filed the writ petition in the Bombay High Court in February 2004 against the Union Government as well as Maharashtra Government for stopping such blatant misuse of funds. Court issued notices to the said governments to file their affidavits in the matter.
