Thank you for ur letter no. 1-5/2001-CN (Vol-II) dtd 26/6/02 vide which u
have forwarded to me BSES Telecom reply (Letter Ref. NIL dtd 8/6/02).
First I would like to state that I have not opted for refund NOT because I
want to continue with BSES but because I have NEVER learnt to run away from
issues (May be my military background has steeled me to face adversity
rather than take the exit route). Thus I will continue my honest efforts
till BSES telecom meets its commitment else offer Refund to all subscribers
through the print or similar media.
Now I would like to enlighten you to the cover-up pack of lies submitted by
BSES Telecom to mislead you :-
a. BSES Broadband pack & CD mentions the Speeds of 64Kbps to 8 MBps. Here
while replying to you, BSES has very cleverly tried to cover-up the speeds
by printing ‘K’ in place of ‘k’. Page 16 of BSES Tele user guide explains
that 1K=1024 byte & 1 byte=8 bits. We know that a dial-up modem is 56 kbps =
56/8Kbps = 7 Kbps. In place of this, BSES Tele is offering a max speed of 6
Kbps. Thus in BSES own words, a 64Kbps connection shared in 1:4 should give
atleast 64/4 = 16Kbps!!!! Which is not happening & is the crux of the whole
issue. This is the first lie from BSES.
b. The 64Kbps shared connection in 1:4 ratio is not mentioned anywhere in
the advertisements, broachers but states that it is a ‘shared connection’.
With the present speed levels, it is obvious that the share ratio is not 1:4
but 1:12 or may be higher. This should be investigated.
c. BSES CD claims that the Home Broadband is ‘Many Times Faster’ than a
dial-up connection. If as per para 1, a dial-up connection is 7Kbps, many
times faster should be atleast 3 times i.e. 21 Kbps !!!!. Another Lie
nailed.
d. Page 17 of User Guide states that the speed of a dial up is ‘Slow’ while
that of Broadband is ‘Very fast & efficient’. DO we call a 7Kbps dial up
slow as compared to 6Kbps Broadband speed being provided by BSES Tele.
Another Lie to you.
e. The statement that “all our customers enjoy high INTRANET BW” doesn’t
make any sense at all as we NEVER subscribed for any INTRANET BW but for
Broadband Internet access. BSES is only creating smoke screen for u.
f. We never asked for a 100Mbps link as claimed by BSES Tele. It is a BLUNT
LIE. We only asked for ‘Many times a dial-up speed’ as stated by BSES Tele
in its CD & broachers.
h. ANy fault booked with BSES Tele, the resolution is never known. There is
no way to know that the fault is cleared except that one has to switch on
the PC and chk for the connections availability. There is no Call report
given to the customer neither the customer is informed by Telephone that the
fault is cleared. However when booking the complaint, the BSES records
customer name, address & Tel no!!!!!. This needs to be streamlined.
I would like to impress upon you that BSES Tele has violated the terms of
offer and may be of the ISP license itself and you need to crack the whip to
make another errant ISP fall in line.
I am sure that now you must have understood how BSES Tele is hoodwinking its
subscribers.

Subject: BSES Telecom, Mumbai - How an ISP cheats its subscribers
Dear All
Pls recall my earlier mails on the subject where it was proved beyond doubt
that BSES Telecom has sold Broadband Internet connection to Residents of
Hiranandani gardens, Powai. However, in true tradition of a street dog, BSES
Tele quietly reduced the access speed to a max of 6kbps (Actually the speeds
vary between 0.5k to 6k as it is a LAN where the speed is dependent on the
no. of users logged in) while keeping the tariff same as that of Broadband
Internet access. Regular follow-ups & numerous mails to Sanjay Pathak, VP
BSES Tele failed to clarify the reasons for cheating. What BSES Tele offered
to me & my fellow residents was a refund to buy our silence. We chose to
ignore the offer as it was made only to a few users who chose to challenge
the might of BSES Tele. Pls note that BSES Tele is continuing to sell
Broadband Internet connections to users across Mumbai. The modus operandi is
quite simple. Keep download speeds in the range of 100-200kbps for initial
2-3 months & then step in with a Managed Network or MAN and reduce the speed
to a max of 6 kbps. BSES Tele has yet to issue the receipt for payment
collected last year in Nov01 when they sold the connections. This also
reflects that the auditors of the company (Attn : Shailesh Haribhakti of
Haribhakti & Co.) are also being misled as there will be no record of the
money rxd from subscribers as no receipts are issued to the subscribers.
All are requested to initiate necessary action within their jurisdiction so
that the Mission & Objectives of BSES Tele as mentioned on its website can
be honored.
I am quite sure that the above misdeeds of BSES Tele wont be known to the
Corporate House (BSES Ltd) & also to the Auditors, who are requested to take
note and do the needful so that the Broadband services as advertised &
contracted for in the offer document are provided to all Broadband Internet
subscribers.
