This is regarding the purchase of 3BHK flat at builder JP (Project name, Jaypee Greens, Jaypee Garden Isles, Sector 133 Noida Expressway, UP?)


I booked a flat in November 2011, via giving 3.5 Lakh amount. At the time of booking, a promise was given to me that, all legal aspects are complete with the project. (paper work, maps, formalities/etc.) And any bank will finance the loan. while JP?s official loan partner bank is Axis bank. Then I started contacting with Banks(initially with LIC and IDBI). But later LIC informed me that, ?there is issue with project documentation, and builder is changing the maps/etc. and revised things are not approved with LIC?. And approval will take minimum two months of time. After that, I started with Axis Bank. (being a JP?s official loan partner bank is Axis bank) But on 30 December 2011 Axis bank also said the same thing as LIC (?builder is changing the maps/etc. and revised things are not approved with LIC?)


Accordingly, I wrote to JP/builder informing the same that, even Axis Bank is denying the loan (in normal period of 15 days). Then the people from JP/Builder side suggested me to go for loan from private bank (as they have less formalities and lenient) On that advice I started the loan processing with ICICI (As at that time, ICICI was the only banking which was providing the loan for JP, Garden Isles) [Note: during this entire time/period, I was continuously updating the JP/Agent persons]


Finally in Feb the loan was approved by ICICI. (during this period JP and Bank people were communicating with other) After the loan approval from ICICI,I wrote to JP via requesting them for not imposing the interest penalty. (And said, then only I will pay the remaining amount) Then, I was contacted by JP peoples (Agent/credit department) and they said, we understand your case (the delay is not because of you, it was because on bank and builder formalities, as maps/etc. were in-process)


So, you (customer/Amit) don?t worry and make the remaining payment. After the payment we (JP/builder) will formally start your case for interest waive off and your penalties will be undo. On that commitment, I made the full payments of (~30 Lakh) and wrote mail for JP/builder for waive off of interest. I did multiple follow ups with JP/builder but got no reply for 2/3 months.


One fine day, on 13 June 2012, got mail from JP/Builder via saying you need to pay the interest/penalty.


This really unfair/unethical with me.
