Delay in Posession

We booked at pre-launch stage in July 2012. The builder had initially estimated a posession date of 54 months from this date which is approx. 2016.


They did not give us a draft of agreement until 2014 despite repeated requests. When we got the draft in 2014 they put a clause of posession of 63 months from date of signing of agreement. So no speicifc commitment on posession date! They have forced us to sign on the dotted line even though this clause is ab initio void and not legal.


Subsequently, they took advanatge of RERA and posted a posession date of 2019 and now revised to 2020.


Now they are telling us that no interest unless they cross the RERA date or the 63 months from signing of agreement date.


Not happy with the way the builder is addressing the issue of interest on delay in posession of the flats
