Nightmare --Continue

Ok!    This is in continuation of my nightmare with the people of Dish TV

*Some thing Miita some thing katta

*This is posted to for the information all the members and also to get some assistance from learned lawyers  for Intimedation, false allegation and mental torture after taking money in advance for their service.

Let me explain again:(Only my set top Box no and VC nos are not been disclosed here to protect me from few more mental tortures:   The action and the Drama!   Installation of DistTv with dish maxi channel Package for one year was done on 13 May 2006 at my residence in Bangalore by dealer and it was activated within 48 hours. With SAF No: . The Set Top Box No is 2007., Make  Koan:  MC100b KSC-100 MCO The VC Card No: . Sony and Star channels were not available at that time in Dish TV hence I have not opted for all those packages at  latter stage also when it was made available.

I came to know about the non-availability of pay channels on 23 Mar 2007 at about 11 AM from Home When I was in my office.  I clled cstomer care  on 24th Morning at around 11 AM, Customer care said the VC was pirated and hence asked me to contact Tele No 0120-2599301  I contacted above Tele phone No: and contacted person  informed me that it has been pirated at Orisa state and place telgoan.(confirmation to be done) he also said that SetMax Channel was retransmitted, ( My VC does not allow neither Sony  package nor Star package) Explained to him that I am stationed at Bangalore and I have not given my set top box and VC to any one.

I had contacted dealer and he visited my residence to take a stock of the situation and said he  willl do the need ful after ascertaining that it is still at the same place where he has installed). I was not asked about my whereabouts  and the availability of my set top box and the VC card by the ASC enterprises or its representative at any point of time, My contact numbers are available with them to ascertain the present state. I called  the technical team twice on 25 Mar 2007 and he asked me call me in the evening as he had to speak to his superior after confirming that my set up box and VC cards are available with me at my residential address only.

When I called in the evening on 25 Mar 2007 at about 7:30 mm pay I was informed that channels would be activated with in four hours. I called again at 11:45 and informed him again about the non-activation. He asked me to leave the Set Top Box on “ON” condition by selecting channel 210 and leave it by switching OFF of the TV monitor till next day morning. It was not available on 26 March 2007, I called the customer care executive and lodged the complaint(Complain No: XXXXX) he said everything is fine and he asked me to leave it in “ON” condition as he is going to refresh once again.

I called Dish TV technical No in the evening and he said from his side everything is all right and asked me to contact customer care. I called customer care and they asked me to leave the set Top Box ON and I shall able to see all subscribed Channels. On Switching On the TV on 27 March 2007 Morning around 8 AM I could able to see the subscribed pay Channels. I received this notice on 27 Mar 2007 after noon through Post from the lawyers of ASE Enter price asking for damage of Rs 5000 for each day from the day of taking connection till date of de activation . ie Rs 15, 55000/- or terminal proceedings against theft and copy right act. and notice charges etc   The Set top Box and the VC card were always at my residence.

At no point of Time the Connection was used for any other purposes. I have not travelled out of Bangalore during this time. I never visited state of Orisa at any point of my life. What legal action should I take to remedy the situation. Hope to post  all the happenings till it becomes prejudise. Should  any one go with Dish TV who used to send notice at the drop of the hat before asserting fact from the subscriber.
