I purchased a samsung captivate on ebay from cellsmania2012_in1 (Kara Distributors) in December 2012. I brought it on EMI offered by ebay under the PaisaPay ID 32619012137. When I received the phone it has some videos and pics of a boy, then I contacted the seller and told him that its has been used by someone before and he asked me to return it and he will send me a new one. I was a bit reluctant to send it and I told him it was fine. If you check the listing there the seller had given 1 year warranty and it is mentioned there that the mobile phone operating system can be upgraded.
When I tried to upgrade it was not possible, I contacted the seller again and he said it cant be upgraded. Then in first week on april the phone mic stopped to work and I contacted the seller and he asked me to send the cell back. On 7th april the cell got locked all of a sudden and then on 8th April I sent the phone back to the seller through Blue Dart Couriers to,

The seller received the item on 9 / 10th April. I called him many times and first he said he has repaired the phone mic and the phone has to be unlocked. Some days back he told me that unlocking is not under warranty and I have to pay Rs. 1000 for unlocking the cell as the cost is Rs. 2000 and he will pay half. Then last week he said that the mic is not repaired yet and first the phone has to be unlocked. It has been more than one month and all my major contacts and everything is in the phone.
I am having a lot of problems due to this. I want my money refunded or he has to give me a new phone. I have paid for the phone in installments through my friend credit card. Now the last installment is due on 16 May 13, I request you not to process that installment till this case is open. I’m sorry to say this but I have a kind of lost trust in buying online from Ebay.
