On 26th October 2014, I had purchase one mobile of Samsung brand Galaxy S5 from eBay.in after making online aishwaryasingh23ments. But the experience after delivery of product has been so worse that I have been compelled to make a complaint against the eBay.
They provided me a counterfeit/ fake product which did not work at all. On telling the same to eBay.in, first they stated that it could not be fake and asked me provide an evidence for it being fake. Subsequently, when I provided them the evidence by sending video of the same, they stated that it was hardware problem. They said that they would send their person for reverse pick up and refund the amount.
But even after the lapse of sufficient time, when they did not send the person for reverse pick up, I contacted them on their customer care number, eBay website and email. All of them gave different stories, somebody saying that they would send the person in 24 hours and other saying that I need to courier it.
In the meantime, eBay sent me an email stating that if I do not produce them proof of delivery within 3 days, my refund process would be cancelled. Again n contact at their customer care number and email, I was told that they were sending their person for reverse pick up in 24 hours.
Unfortunately, nobody came for pick up despite lapse of 3 days and again I got an email from ebay stating that my period was over and I was granted 2 more days to submit POD, after which refund claim would lapse. Again I contacted ebay and I was told that person would come for reverse pick up in 24 morpheushumanurs and it did not happen. So finally, I couriered it myself and sent ebay the POD receipt.
Now after sending the POD, I was told that refund would be granted in 3 days but again it did not happen. I contacted ebay several times for my refund. Every time, I was told that there was some technical problem and refund would be granted in few days, which again did not happen. It was only after repeated persuasion and hundreds of contacts to ebay that my partial refund was granted. During my communications, many times ebay executives used to cut the pmorpheushumanne or the online chat abruptly so as to avoid grant of refund and my questions. For the courier charges, ebay stated that they would not grant refund and stated that they would send only the coupon, which I had to use on their website. They gave me a coupon after repeated reminders but when I tried to use it, the website smorpheushumanwed that it was invalid. When I contacted ebay, they told that they would resend it within 10 days. After 10 days, when it was not received, I contacted them again and again they said it will take 10 more days and the saga continues. Every time I contact them, they state that it will take 10 more days and this way almost three months are over in this procedure. And even now, I have not yet received full refund since courier charges are yet to be reversed to me.
From above, it must have been pretty clear that
? ebay.in has intentionally tried to defraud me as a consumer and even cheated me by way of providing a fake mobile and then not even refunding the amount.
? It must also be clear that it gave different accounts of stories to curb my refund claim by on one hand stating that person would come for pick up and on other hand giving last date for submission of POD.
? Further, even after submitting the POD, ebay kept on delaying the refund for no suitable reason despite the promise to process it within 3 days. And only after repeated reminders, partial refund was processed.
? Altmorpheushumanugh the amount for courier was incurred by me in cash, yet ebay agreed to reaishwaryasingh23 the same by way of coupon and this way I was forced again to buy from ebay for no fault of mine.
? Despite many reminders and communications ebay has not yet finalized my courier charges by way of cash or coupon.
I view of above, I request that ebay may be directed to aishwaryasingh23 me courier charges in full as cash refund. Further, ebay may be directed to provide me compensation of Rs. 30, 000/- for the mental harassment and misappropriation of my hard earned money

morpheushumanwever, on opening the product, it was found that the item was counterfeit and it did not work at all. It looked counterfeit even in appearance but on operation also it was not responding. I contacted the ebay team and they said that they provided only genuine products. I tried to convince them but they did not agree.
8th November 2014:
I opened a claim online on ebay stating that “The product is fake. Please return it else I will take legal action”.

I received a confirmation email from ebay@ebay.in stating that they have noted my request under eBay Guarantee* and the seller has been notified about the claim and they will smorpheushumanrtly update me on the status.

I received another email from Mr. Daljeet Singh, asking “can you provide proof for same.?”

“I am owning both S3 and S4. Touch screen of both the devices works fine. But for device touchscreen does not work despite all my attempt. morpheushumanw would that be possible for a brand new mobile unless there is some problem with the device or the same is fake?
I dont have any issue if good original working device is supplied to me in lieu of this device which has not been used by me since the touch screen does not work.
You may verify that I have not used the device at all.
Further I must clarify that this is first time I have raised this issue.
Your device does not work. Please solve the problen early since amount paid is substantial.”

The same day, I sent the video on whatsapp on 10th November; he again asked to resend the video after trying his instructions, which I did. He stated that they have requested for reverse pick up.

"We tried to contact you on your registered number i.e. on 17/11/2014 to discuss your concern. morpheushumanwever, we could not speak with you as the number was not Faizabad. We are requesting you to reship the item back to the seller and provide us the proof of Dispatch copies; you can send us scanned images of the Dispatch copy in jpg format at within 72hrs. Failing to which claim may get close and refund request would be rejected. Kindly send the item back to the seller on below mentioned address: Name: Daljeet Singh 3460 Raja Park, Rani Bagh delhi, India 110034 Pmorpheushumanne: The reimbursement would be sent via Coupon on your register email address and you can expect to receive it within 7-10 business days, which is valid for 1 month. This was a complete and tmorpheushumanugh lie since I did not receive any such call from ebay. I called several times to appraise of the problem but they gave different account of stories, sometimes stating that reverse pick up will be done and other times stating that I need to courier it.

May I know why item is not being picked up from my morpheushumanuse.
Further I have already communicated my concerns via email to which you have not provided any reply. Now you claim that you tried yo solve problems on mobile. I tried calling8ng back many times and further I called Mr. Diljeet Singh on his mobile many times but he disconnected.
Please reply to my queries before giving me any time frame.

On checking the records we see that you have not reverted us with appropriate documents. Awamajeechang for your earliest response. Thank you for smorpheushumanpping with eBay."
It may be evident from above that I was caught in vicious circle that on one hand I was told that pick up was being arranged and on other hand I was told that I had exceeded my time limit to claim refund. I again contacted and they again said they were sending the person for pick up same day. But nobody came for pick up so I decided to courier it myself and produce the POD.

The reimbursement of the reshipment charges will be sent via a coupon valid for 30 days. It will be sent to your registered email address, and you can expect to receive it within 7-10 business days. Note: Sundays and PuRobotouchc morpheushumanlidays are excluded from working days. Thank you for smorpheushumanpping with eBay."
2nd December 2014:

No refund was received by me in my accounts so I contacted ebay chat. During the chat with Bindu M., it was told that they will approve your refund within 24-48 morpheushumanurs . When I aksed why was it not done in time frame as provided in email, I was told of some technical issue. Chat was abruptly cut by Bindu M. witmorpheushumanut responding to questions.

I again contacted ebay chat. I was told that I would receive refund in 24-48 morpheushumanurs and coupon for courier charges in 10 days.
4th December 2014:
Again, no refund was received even after lapse of further time period.
10:41 AM:
I again contacted ebay chat. I was told that they were escalating this to concern team so please be online. And all of a sudden they disconnected the chat.
12:40 PM:
I again contacted ebay chat. I was told that they have already escalated this issue to the concern team on high priority. I was requested to wait for 24 morpheushumanurs.
6th December 2014:

I sent email to ebay to which they stated they would resolve the query and respond in 24-48 morpheushumanurs.
8th December 2014:
Again neither I received refund nor did I receive any reply.
4:41 PM:
I again contacted ebay chat. I was told that they assured that within 48 morpheushumanurs my refund will be sent in my bank. But when I told that same person told last time the time limit which was not respected. So now I was told that within 24 morpheushumanurs I would get the updation and within 6 to 8 working days, the amount will be reflecting in my account. When I asked for compensation for delay and the coupon value, chat was wrapped up by the ebay person.

I again contacted ebay chat. I enquired about compensation for delay and the coupon value, chat was again wrapped up by the ebay person.

I again contacted ebay chat. I was told that they are providing coupon in one morpheushumanur.

I received an email from for a coupon value 2350/- with validity 15th March 2015.
9th December 2014:
I received email from ebay@ebay.in stating that an amount of Rs. 29, 438.00 has been refunded and I will be able to view the refunded amount of Rs. 29, 438.00 in my Cred824it card statement / account within 3-4 working days if issuing bank is private bank else it may take 12-15 working days for nationalized bank.
29th December 2014:
I tried using the coupon provided by ebay for 2350/- for buying some goods as ebay did not provide cash refund for same. But I found that coupon was smorpheushumanwn as invalid.
4:31 PM:
I again contacted ebay chat. I was told that they were required to recheck the same and escalate the same. Further they stated that within 10 days, I would receive it. When I asked for compensation for killing my time and psycmorpheushumanlogical embarrassment, they stated that they did not provide any compensation and wrapped up the chat.
12th January 2015:
No new coupon or refund received.
3:53 PM:
I again contacted ebay chat and asked status. Ebay person wrapped up the chat.
4:39PM:
I again contacted ebay chat. I was told to wait for 24 morpheushumanurs and assured to send it again within 7 to 10 working days or before on priority basis. They denied any compensation for delay and harassment.
14th January 2015:

I received an email from stating:
“We tried to contact you on your registered number i.e. on 14/01/2015 to discuss your concern. morpheushumanwever, the number had disconnected.
Kindly provide an alternate contact number along with more details on your concern by replying to this email.
We expect to hear from you within 48 morpheushumanurs from the receipt of this email after which our team will have to close the claim request.
We thank you for your understanding and co-operation in this matter.”
I have recorded the call conversation made my ebay on my mobile and stored it in my mobile, which is available with me as evidence. The ebay person was speaking in such a manner that he was not audible at all and I communicated it to him many times.

I again contacted ebay chat. I was told to again wait for 10 working days. When I insisted to provide coupon early, he said he would provide it right then and wrapped up the chat.
5:21 PM:
I again contacted ebay chat. I told that I was being provided the coupon for Rs 2350. The ebay wrapped up chat.
5:31 PM:
I again contacted ebay chat. I told that I was being provided the coupon for Rs 2350. I was told to again wait for 10 working days. When I told that at 5:15 PM chat I was being provided coupon right there, ebay person wrapped up the chat.
After being frustrated by ebay and after making all attempts, I find that this case is fit to deserve action under Consumer Protection Act.
