Had a terrible experience with Foodpanda recently for one of my orders with The Kadhai Kitchen in Powai, Mumbai.
I had ordered from The Kadhai Kitchen in Powai, and when the food was not delivered even after 1.5 hour and multiple follow-ups with Foodpanda and restaurant(I was on phone with Foodpanda for almost 40 minutes) I ended up ordering food with other restaurant. Finally the restaurant guy decided to show up, and when I asked him to leave because I had already placed order with another restaurant he refused. I called Foodpanda guys and they informed me that they will not be refunding my money back because the food was delivered and I am not taking the delivery.
According to Foodpanda, the guy was in my building within the hour but it took him 30 minutes to get the pass made. I asked them then howcome the entry pass showed the time of entry at 1.5 hours, they had no asnwer but kept repeating the same thing that they will not be refunding the money back. I had had enough. I was hungry and I waited for these guys to deliver the food for more than 1.5 hours, and I had no energy left to fight with these highly intelligent people at Foodpanda, so I told them they can do what they want but I will not accept the food delivery under any circumstances.
Here is my issue with you guys -
I paid you guys for delivery of the food, and you guys took the money for delivering the food within a reasonable time. That is the contract for sale. Now, since the food delivery was not taken because you guys were delayed, then under what pretext are you guys keeping the money with you?
While placing the order, you guys had shown the time for delivery to be 60 minutes which was later increased to 70 minutes when the order was placed. Even this was long enough. Then why do you think it was okay for you guys to deliver the food more than 1.5 hours late? Please note that the distance between the restaurant and delivery location was hardly 15 minutes.
You told me that since the food is prepared, it can not be cancelled, then tell me this - if you guys prepare the food and deliver it in 4 hours, will that be acceptable? If you want to deliver food as per your schedule then why show the time for delivery at all then? It will be better to order tomorrows lunch today with the speed with which you guys are delivering.
If you are saying the guy did infact come at the delivery address within the hour then what explains the entry time, which clearly shows he was there only after 1.5 hours, on his entry pass?
I have taken my share of rubbish from you and your staff and I don;t think you guys have answers to any of my questions. You people had the audacity to tell me that since you can not refund my money you can give me 50 RS apology voucher! Please keep that with you, I am sure you will need it.
I am not sure what recourse is left with me since I have already paid you guys for the food which was never delivered apart from going to the consumer court. I know it will be a long process and I am not sure if I want to do that for such a paltry sum, but I am thinking of doing that just so that you guys learn a lesson and stop your idiotic tyranical acts and treat your customers as they are ought to be treated - fairly. You have clearly breached a contract to sale, as no delivery took place and that is ground enough for me.
I will certainly not be ordering anything from you guys ever again and will make sure to tell everyone about this incident so that they can make a sound choice for themselves.
