I had placed an order for a 5ft 6 inch width bed with Italuxe furniture on 16/6/2013 and made full payment on 21/6/2013. To confirm the delivery I had called the main proprietor Junaid on 22nd and 23rd June, but he did not pick up our phone.
The bed that was delivered on 24/6/2013 was 5 ft 3 inches in width. I immediately called Junaid to tell him of the error, but did not again pick up my phone. Next I called the shop and told them of the error. They claimed to have no knowledge of the error, and therefore I returned the bed.
Since 24th June I have been calling the shop almost on a daily basis, and Junaid finally decided to return my call on 1/7/2013 saying that he would refund the entire money by 3/7/2013. As the date came and went, he gave me other fictitious dates on which he would refund the money but has not refunded my money till date.
We have the printout of the order and payment made from my side for the order. I wanted to know what was the best way to recover my money in this case - should I file a police complaint or go to a consumer court for the same?
Also avoid this shop in Bandra - they have good furniture on display but will send you whatever piece they need to get rid off and not what you asked for. Also they will blatantly lie about the refund - I have several SMSes of various dates on which the refund was to be given.
