Lenovo S860(Titanium) hanged on delivery, dead now

Lenovo S860(Titanium) purchased from Amazon.com started hanging from 1st day of purchase, taken to local service center 5 times, but now they say it was a hardware fault for which I have to pay heavily, as now out of warranty. [Incident: 151209-000082]. Please help me get back my money, as company is sending, standard copy paste reply denying my claim, as detailed in my latest email to the company as below:


This moble handset Lenovo S860(Titanium) was purchased at Amazon for Rs.20, 070.00 on Ordered on 12 June 2014 Order# 171-4120759-9595527, IMEI No./ Serial No.863336027320765, Sold by: IT GADGETS


This is further to my couple of calls/ web complaints via web page at Support website/ emails to you, since its delivery on 16 June 2014 [Incident: 160604-001196]  reporting that the handset did not start on receipt. Your call center guided me to your local service center, which kept the handset for a day and returned after repairing/ updating etc.


This handset was again repaired/ updated at your Nashik service center, within a week of purchase and further 4 times, almost every quarter for 11 months, since date of delivery on 16 June 2014, due to same manufacturing defects in its Motherboard.


For total four months together it was lying in your service center at Nashik, Mah. during the warranty period, as such its warranty period also automatically got extended for the same period of four months to 16 October 2015.


The same initial manufacturing defect continued during entire warranty period and have been to your local service center several times. Most of the time I was wondering why it is hanging again and again.


On 20 Sept 2015, I emailed you that its defective & weak motherboard has finally failed and your Nashik service center finally agreed  that it needs to be replaced urgently, as it’s defects appeared on day one of purchase itself.


Other handsets by your competitors 5-10 years old are still working smoothly.


I repeatedly requested you to arrange to get the motherboard replaced at your Nashik service center, as it is a genuine case, within warranty, as detailed above.


I repeatedly requested you by phone/ emails since 16 June 2014,  to look into this matter and guide me to get a replacement / refund as all repair records are already with your Nashik Service center and the Company online, which you have failed to share with me, very smartly. Your service center chief just gave me his visiting card only as a proof of my handing over the handset to them.


But your company of repute kept on sending me back to the Nashik service center again and again, despite my frantic calls to your toll free to replace or refund.


I had Hoped a company of your repute shall help me out, as it is a very expensive phone and and a senior citizen of 66 years, I cannot suffer such a big loss in silence, but you finally rejected my claim as out of warranty, despite my reporting you the manufacturing defects in warranty period itself, from the date of receipt, despite my repeated requests on phone and emails.


By marking a copy of this email to Pahredar at MoneyControl.com I am requesting them to help me get my full refund, as I have finally lost faith in your company and do not wish to keep rushing the defective handset to your service center for repairs anymore.


Please treat this email as a Legal Notice and refund me Rs. 20, 070.00 in full, by Bank Draft failing which I shall be compelled to lodge a case against you in Local Consumer Forum, Nashik for the amount paid with interest at market rates, with adequate compensation for Mental Tension, harassment, loss of business opportunities for four months, during the handset did not function etc. etc., besides sharing this on Mouthshut.com/ social media/ FB/ Twitter etc., at your costs, risks and responsibility, which may damage your reputation.


Please acknowledge receipt and respond per return.
