I had purchased and paid for the following items on Jan 26th via invoice number 9239 at your Gurgaon Home Centre.

Item code 0470188689999 - 1 Qty – Ophelia 3 str
Item code 0400840393602 - 1 Qty – Ashville Coffee Table
Item code 0400840403602 - 2 Qty – Ashville End Table
The payment for the above mentioned items was made via 2 credit cards for Rs. 45000 and Rs. 19190 for the total bill of Rs. 64, 190.
The material was delivered on Jan 30th and the following defects were noted.
The 3 str was of a different shade than the one agreed for and the 2 str and 1 str were of a different shade. The color/shade difference was totally incompatible and non acceptable as I had ordered for a shade A as per the set I was shown on the floor at the time of payment.
The coffee tables had repair patches on the top and the end tables legs were damaged.
These were immediately notified on the copy of the delivery receipt number 2287 dtd Jan 29th’11. The same was also communicated to Mr. Dinesh and Mr. Sandeep Takran via telecom.
Upon my visit to the store for replacement I was informed by Mr. Sandeep Takran that the Ophelia set I had bought had this problem from the supplier end and no two sets could be found in the same color/shade for replacement as there were 4 different shades supplied by your supplier from China. He had specifically mentioned that if I wanted he would arrange for the reversal of the complete payment I had made for Rs. 64, 190 as the material supplied was not in accordance with the agreed specification at the time of payment and also that neither he or nor Home Centre was in a position to have the material replaced as agreed earlier.
Now when I have requested for the cancelation of my order and the amount to be reversed and credited back to my credit card, Mr. Dinesh and Mr. Sandeep and have grossly denied having made any such comments and are offering me a credit note.
Please note that Home Centre has failed to complete its obligation as agreed at the time of payment and it is not my fault where as I had paid the agreed amount in utmost good faith. Therefore a credit note is absolutely not acceptable.
Hence I would request an immediate action on this matter and have my payment of Rs. 64, 190 reversed and credited to my account failing which I would be forced to initiate action against your store in the consumer court and claim damages.
