Leave & License - rented flat in Mumbai

Just today, I got the registration for leave and license agreement for my rented flat in Lokhandwala, Andheri. As this time, my company was not paying my part of the registration charges, I did the process myself without any broker. Since it is a long process and nowhere is it documented in detail, I thought I will share my experiences with you.


As the 11-month lease of my house expired, I had to get it renewed. Around the same time, broker who arranged for the deal originally gave a call reminding that he has to start process for renewing our lease. As I was planning to do this myself, I told him so. Still, I had to pay him the brokerage charges (half the initial amount). But I cut him out in the registration process and for registration charges.


I got the agreement printed on stamp papers worth Rs 750. These rates were lower sometime back and have been hiked recently, but the lowest value is Rs 750. Depending on value of rent and security deposit, the stamp duty could be higher. The landlady wanted the agreement exactly as the previous one, so preparing it was not a problem. A sample copy of agreement can also be found on MMRDA site.


Each page of the agreement needs to be signed by both the leasor (landlord, in this case) and the leasee (authorised signatory from my company as my company was taking over the lease for me). The witness’ signature also should be there at the required place.


One day before registration, a token number has to be taken on phone. But the phone call has to be made only between 10 to 11 am in morning. A DD or pay order for Rs 1000 as registration charges also has to be prepared. It can be prepared at the bank in MMRDA building just opposite. In fact, if you tell them you need a DD for L&L, they will stamp the form with the payee’s name (which is rather long). The photocopy of DD has to be presented at L&L office, on same day itself for the token number to remain valid for next day. An agreement form also should be filled.


On the day of registration, be sure to arrive at scheduled time. Make sure that all parties- licensor, licensee, 2 witnesses are there. You must have the original agreement copy, DD, and filled agreement form. Once your time comes, rest of procedure is faster and you would be guided by the staff. They would take pictures, fingureprints. etc. and keep all documents. You will have to shell out around Rs 250 again (Rs 20 per page of agreement). You will be asked to get a butter copy of the original agreement copy and this would be kept by L&L office. The original is kept by licensor.


So, in all you would be paying around Rs 2000 for the process, which would normally be shared equally with the landlord. If you would have gone through a broker, it would have made your wallets lighter by further Rs 1000 each.


The staff was by and large co-operative. And, you dont have to pay a bribe !! But the systems and processes at office are not very helpful. There is only one phone number from where you have to take token number. It always came busy and I got through only after trying continuously for 30 minutes.
