I am reproducing herebelow my response to a legal notice issued to me by m/s reliance communications ltd. I believe the response will leave no one in doubt about the quality of the service rendered by reliance on their data cards:
Adv. Ashutosh m. Kulkarni,
7 a+b gurudatta colony, karve nagar,
Pune 411 052.
Dear sir,
Sub: Final chance!
I have for reference your letter no. Reliance/concl/3304/feb2011 dt. 9/2/2011
Threatening me with legal action for failure to make payment of a sum of rs. 2542.92, claimed by you as arrears. I have to tell you that the boot in fact is on the other foot. I have myself been contemplating legal action against the company and your letter gives me the opportunity to do just that.
Let me first explain the circumstances to you. While using the reliance datacard, I discovered to my immense chagrin and considerable annoyance that the card has been so programmed that it opens the reliance website unbidden and on its own with metronomic regularity every half an hour or so. If this wasnt bad enough in itself, i also discovered that the data card did you the additional favour of closing down forcibly any website you might have been currently working on and led you by the nose to its own(reliance) website. Obviously the work of some megalomaniac. The experience is ludicrous, frustrating and infuriating. Particularly if you have unsaved data on the website you have been working on and that data is completely lost, necessitating you to begin work all over again. I spoke to your customer service executive at margao and the only explanation i received was that this was experienced by all users.
I wrote two e-mails to your customer service cell and the response in both cases were identical, dismissive and demeaning to the user: that this was an additional service "for your benefits only(sic) and there is no feature available to disable the same". What was left unsaid: if you dont like it, you can stuff it. We couldnt care less so long as we get our money.
Faced with such blatant disregard of issues involving customer service for which the customer is paying out good money and the shameless flouting of all norms of business ethics, i had no alternative but to stop making further payments. In view of your sustained and demonstrated incapacity to rectify the situation on the one hand, and your currently unjustified claims for recovery of arrears on the other, I have now decided to proceed against you for deficiency of service as defined
Under the consumer act and call upon you to refund all sums of money paid by me for your services since inception as follows:
Bill no. Particulars amount
Cost of data card 2200.00
342383335389 25/2 to 7/6 393.17
342468938640 11/6 to 10/7 1071.64
342566148164 11/7 to 10/8 852.03
342657980699 11/8 to 10/9 827.37
342753462948 11/9 to 10/10 815.68
Total . 6159.89
As for your invitation to conciliation at your porvorim office, i have to respectfully decline the offer as it is extremely far away from where i stay and my health does not permit me to travel that far. In any case, your responses so far to my specific complaints have been anything but satisfactory and i see no point in subjecting myself to the further ignominy of hearing a reiteration of the same stupid excuses i have received so far. If you have anything fresh to add to what you have already said in your defence, you may supply such fresh information to me either by e-mail on scvajpey@rediffmail.com or on my mobile number 94207 85170. I see no justification in your pompous directions to me to appear before a conciliator as if i were in the dock and you were some omnipotent force invested with judicial acumen - your incompetence denies you that cover!
Yours sincerely,
(s.c. Vajpey)
