I took bike zeus on Jan 7, 2009 at bangalore from Aerolex Dealer and found that bike was defective [ bike was going to left side and it has cross ==> that mean handle bar was not position proprely because of chassi problem in bike. Even the top guys namely Vinod Natrajan from suzuki inspected the vehicle and could not rectify the issue. I asked them to replace the bike but they accepted saying that bike has manufacturing fault but they took there words back and said that we can’t replace bike as it is against company policy. ORDER
This Complaint is allowed. It is held that there is deficiency in service on the part of the Opposite Party. The Opposite Party is directed to take back the said vehicle from the Complainant and refund the cost of the vehicle i.e., Rs.53, 674/- (Rupees fifty-three thousand six hundred and seventy-four only) to the Complainant. The Opposite Party is further directed to pay a sum of Rs.3, 000/- (Rupees three thousand only) to the Complainant by way of cost of this litigation. The Opposite Party is granted 30 days time from this date to comply this Order.
This Order is pronounced on this the 24th day of November 2009.
Suzuki motorcylce went for appeal to state commissoner , Bangalore (Appeal 4339/2009) and lost the case there also
