I had sold my Ford Ikon which was covered by Tata AIG Insurance just after 2 months of paying the premium. The buyer was very reluctant to make the insurance change and he was pushing me for all the wrong ways to claim insurance for him and give it to him. I was very clear that I will not put in false claims and made the transfer to him once the payment was made. I had also got the hypothecation cancelled and sent him all the documents.
Unfortunately, the day he bought the car from me, he went and banged. I am actually not very sure if it was intentional or by mistake, because the description of the accident was so. He said that he had banged the front right side of the car on the gate and the whole front side crashed. A ford Ikon is not so easy to crash unless it is going in a good speed. When putting your vehicle near the gate, you cannot gain speed.
Anyways, I told him that its no part of my insurance any more and that he has to lodge a complaint, change the name of the insurance and go ahead. But he was insisting that I do the claim in my name and give the money to him. I was reluctant.
Suddenly after 3 days, I received a message from Tata stating that my insurance claim is under process. I called Tata and waited on their IVR to reach a real person. The I explained the things to him. They seemed to understand, but the problem again was, they had no solution. The worst part was, the buyer has made the claim in my name in the Tata website. And Tata seems to be processing it. I made it clear to the Tata guys that this is a case of fraud and no claim can be made in my name. They assured that without my signature nothing can move forward.
After a week, I got a call from a local Tata insurance guy (who also claimed to be a direct employee of Tata) and he was asking me for the papers which I had and all. I informed him again of the situation and made it clear that I am not parting with any originals (transfer papers). He asked me to scan and send the papers, which I did.
Till date there is no news from Tata and not one from the buyer too. I am just keeping quiet as I am very sure, if something goes wrong, Tata will face me in the consumer court !
